RE: Allowable Dates for Runoff Elections

Under Section 41.001(c), another election may not be held within 30 days of a primary election, including the May 27 runoff primary election. Our office understands that this creates a limited window for cities, schools and other political subdivisions to hold runoff elections from the May 10 elections.

Therefore, the Secretary of State has adopted 1 T.A.C. 81.420 (copied below), and effective May 27, 2014 to provide more time for runoff elections. Under this TAC rule, you may hold a runoff election between Monday, June 16, 2014 and Saturday, July 5, 2014.  You may not hold a runoff election before June 16 or after July 5.
