STATE BOARD FOR EDUCATOR CERTIFICATION
RULE REVIEW PLAN

In accordance with the House Bill Number 1, 75th Legislature, Regular Session, 1998-1999, Article IX, Section 167, the State Board for Educator Certification submits the following plan for review of their rules.

SUBCHAPTER TITLE SUNSET REVIEW DATES COMMENTS

Subchapter A. Chapter 230, Educator Preparation Accountability System (Renamed Assessment of Educators as of March 1, 1998).

Repeal effective March 1, 1998.

§§230.1-230.4 were repealed. §§230.5-230.6 address Educator Assessment and will be repealed and rewritten pending approval of the new educator certificate structure and the Framework for Educator Preparation and Certification.

Subchapter D. Chapter 230, Local Cooperative Teacher Education Centers

Repeal effective August 1999.

Subchapter E. Chapter 230, Centers for Professional Development and Technology

Repeal effective August 2000.

Subchapter F. Chapter 230, Professional Educator Preparation

Repeal effective August 2000.

Subchapter G. Chapter 230, Program Requirements for Preparation of School Personnel for Initial Certificates and Endorsements

Not yet available; schedule will be proposed prior to January 1, 1999.

Cannot project a schedule for these rules until a new certificate structure has been developed.

Subchapter H. Chapter 230, Alternative Certification of Teachers

Repeal effective August 2000.

Subchapter I. Chapter 230, Standards for Approval of Institutions Offering Graduate Education Programs for Professional Certification

Repeal effective August 2000.

Subchapter J. Chapter 230, Graduate Education Programs for Professional Certification

Not yet available; schedule will be proposed prior to January 1, 1999.

Cannot project a schedule for these rules until a new certificate structure has been developed. §230.304 relating to Professional Administrator’s Certificates may be repealed by February, 1999 pending adoption of new principal and superintendent rules. The issues of mid-management and certification for central office personnel remain questions that the new certificate structure will resolve.

Subchapter K. Chapter 230, Alternative Certification of Administrators

Repeal effective August 2000.

The issue of mid-management and certification for central office personnel remains a questions that the new certificate structure will resolve.

Subchapter M. Chapter 230, Certification of Educators in General.

Repeal of §230. 414 effective January 1, 1999

Repeal of §230.412 effective January 1, 1999.

Repeal §230. 411 and §230.413 effective August 2000.

§230.414 will be repealed as the new disciplinary hearings and sanctions rules are adopted.

§230.412 will be repealed as rules for classes of certificates and renewal and continuing education rules are adopted

§230.411 and §230.413 regarding the purpose and general requirements will be repealed once new rules for the certification of educators in general are adopted.

Subchapter N. Chapter 230, Certificate Issuance Procedures

Repeal effective September 1999.

Subchapter O. Chapter 230, Texas Certificates Based on Certification and College Credentials from Other States

Repeal effective May 1999.

Subchapter P. Chapter 230, Requirements for Provisional Certificates and Specialized Assignments or Programs

Not yet available; schedule will be proposed prior to January 1, 1999.

Cannot project a schedule for these rules until a new certificate structure has been developed.

Subchapter Q. Chapter 230, Permits

Repeal effective August 1999.

An interim amendment was effective March 1, 1998.

Subchapter R. Chapter 230, Record of Certificates

Repeal effective August 1999.

Subchapter S. Chapter 230, Paraprofessional Certification

Not yet available; schedule will be proposed prior to January 1, 1999.

Cannot project a schedule for these rules until a new certificate structure has been developed.

Subchapter U. Chapter 230, Assignment of Public School Personnel

Not yet available; schedule will be proposed prior to January 1, 1999.

Cannot project a schedule for these rules until a new certificate structure has been developed. Some amendments will update the assignment tables to reflect changes in required courses and the Texas Essential Skills and Knowledge (TEKS). Interim amendments will be effective September 1, 1998.

Subchapter V. Chapter 230, Continuing Education

Repeal effective January 1, 1999.

Subchapter V will be repealed as rules for classes of certificates and renewal and continuing education rules are adopted.

Subchapter Y. Chapter 230, Definitions

Repeal effective January 1999.

Subchapter Z. Chapter 230, General Provisions Relating to the Transition of Authority to the State Board for Educator Certification.

Repeal effective April 6, 1998.

Chapter 240. American Sign Language Certificate

Repeal effective September 2001.

This rule would probably be updated and placed in a different chapter along with standards for other certificates.
