Rule Review Plan
Pursuant to the Administrative Procedure Act (APA), Texas Government Code §2001.039, Agency Review of Existing Rules, the Public Utility Commission of Texas (commission) proposes the following plan to review all Commission rules and to determine, at a minimum, whether the reasons for adopting the rules still exist.
The rule review plan runs from fiscal year September 1, 2007 through August 31, 2011. Project Number 34569, Review of Agency Rules Pursuant to the Administrative Procedure Act §2001.039 for FYs 2008-2011, is assigned to this review plan.
The commission will initiate a new project each fiscal year for the review of the chapter(s) scheduled for that year. Actions to amend, repeal, or adopt rules may begin independently of this schedule if required by legislative action, court decision, commission decision, or other causes. In those instances, reasonable opportunity for comments will be provided pursuant to APA §2001.029.
Schedule for Review of Commission Rules
Agency to Begin Review on September 1, 2007: Chapter 21 and Chapter 27
Agency to Begin Review on May 1, 2008: Chapter 22
Agency to Begin Review on September 1, 2009: Chapter 25
Agency to Begin Review on December 1, 2009: Chapter 28
Agency to Begin Review on September 1, 2010: Chapter 26

16 TAC Chapter 28, Substantive Rules Applicable to Cable and Video Service Providers.
